Information on the processing of personal data
Information on the processing of personal data and instructions within the meaning of Act No. 101/2000 Coll., on the protection of personal data, as amended (hereinafter referred to as the “Personal Data Protection Act”) and consent to the use of electronic contact details for the purpose of disseminating commercial communications by electronic means within the meaning of Act No. 480/2004 Coll., on certain information society services and on amendments to certain acts, as amended (hereinafter referred to as the “IS Services Act”)
Amenity Resorts s.r.o., with its registered office in Prague 4- Kunratice, Ratajova 1113/8, ID No.: 27650626, e-mail contact: amenity@amenity.cz (hereinafter referred to as the “Company”) processes or will process personal data about you as a personal data controller, all within the meaning of the Personal Data Protection Act, which you have provided or will provide to the Company, in connection with the provision of accommodation services by the accommodation provider (the Company) in the premises operated by it (a complex of accommodation and recreational and sports facilities – Amenity Resort).
Pursuant to Sections 5(4) and 11 of the Personal Data Protection Act, we hereby inform you that:
- personal data of you and your fellow travellers, which must be filled in (or are automatically filled in according to the data entered) in the booking form located on the website www.amenity.cz (hereinafter referred to as the “booking form”), are provided for
- for the purposes of negotiating, concluding, performing the accommodation contract and for any claims arising from it (except for the personal data of fellow travellers), and, if you opt for trip cancellation insurance, for
- for the purposes of arranging, concluding and performing the trip cancellation insurance contract, and for
- for the purposes of keeping the registration book and fulfilling the Company’s obligations as an accommodation provider under Act No. 565/1990 Coll., and in the case of foreigners also for
- 326/1999 Coll., and for the purposes of keeping the house register and fulfilling the Company’s obligations as an accommodation provider pursuant to Act No.
- for business and marketing purposes, in particular offering trade and services, informing about offers, events and activities of both the Company and third parties – GOLF EXPLOITATION, s.r.o., company ID 25154010, with registered office in Prague 4 – Kunratice, Postal Code 14800, Ratajova 1113/8, e-mail contact info@golf-exploitation.cz and persons forming a concern with the Company within the meaning of the relevant legislation, in particular 3M Developer, a.s., IČ 27196585, with registered office in Prague 4 – Kunratice, Postal Code 14800, Ratajova 1113/8, , e-mail contact: info@3mdeveloper.cz, and offers made by both the Company and these third parties, as well as sending commercial communications pursuant to the IS Services Act (except for personal data of fellow travellers) by the Company and the third parties referred to in this paragraph, which will include commercial communications concerning products, services, products and activities of both the Company and the third parties referred to in this paragraph;
- the scope of the disclosure:

- for the purposes of 1) i.- name, surname, residence, date of birth, email and telephone, start and end dates of stay, amount of accommodation and services related to accommodation,
- for the purposes of point 1) ii. – name, surname, date of birth or other identification and other data as requested by the insurance company, booking number and price, start and end of the booking,
- for the purposes of point (1)(iii) – in the case of a natural person liable for the local tax, the duration of the accommodation, the purpose of the stay, the name, surname, address of the place of permanent residence or permanent residence abroad and the number of the identity card or travel document,
- for the purposes of point (1)(iv), the name of the foreigner accommodated, the day, month and year of birth, nationality, travel document number, the beginning and end of the accommodation, and
- for the purposes of point 1 v. – name, surname, address (including telephone and e-mail address);
- due to the nature of the existing (and potential) mutual relationship (contractual relationship), the provision of the above data and/or consent to its processing (if required) is voluntary. However, refusal to provide them to the extent requested will generally result in the impossibility of concluding the relevant contract (data provided for the purposes contained in point 1(i)-(iv)). The Company may only process personal data and disseminate commercial communications with the consent of the person to whom the data relates, unless otherwise provided by law. The Data Protection Act and the IS Services Act provide for exceptions where consent is not required to process personal data. The Personal Data Protection Act does so in Section 5(2), where the processing of data is necessary for the conclusion and performance of contracts or for the protection of the Company’s rights and legally protected interests (data under (2)(a) and (b)) or for compliance with a legal obligation imposed on the Company by law (data under (2)(c) and (d)), and in Section 5(5), where the Company, if it has obtained personal data from you in connection with its activities, may use data in the scope of name, surname, address for marketing purposes for the purpose of offering a business or service. The IS Services Act provides an exception in Section 7 where consent is not required to send commercial communications relating to its own similar products and services where the Company and/or companies have obtained electronic contact details for electronic mail from its customer in connection with the sale of a product or service as required by the IS Services Act, provided that the customer has the opportunity to refuse consent in the manner provided by law if it has not already done so. You may withdraw your consent to the processing of the personal data provided at any time in writing, and you may object to the processing of data for commercial and marketing purposes and to the sending of commercial communications by e-mail to your e-mail address at any time, either by contacting the contact addresses listed in this Information or, when sending an individual message by e-mail, also by clicking on the relevant message box, whereby you may refuse to consent to the use of your e-mail address. Given that the Company, or companies forming a concern within the meaning of the applicable legislation (in particular 3M Developer, a.s., ID No. , with registered office in Prague 4 -Kunratice, post code 14800, Ratajova 1113/8) and GOLF EXPLOITATION s.r.o., IČ, with registered office in Prague 4 – Kunratice, Postal Code 14800, Ratajova 1113/8, which, like the Company, are engaged in the field of accommodation and sports and recreational services (complex of accommodation and sports and recreational facilities – Amenity Resort), intend to send you electronically communications and offers in the field of marketing, offers and business support relating to the entire segment of their services and products, your consent is required for these purposes. If you do not refuse your consent to the sending of commercial communications and the processing of your personal data for these purposes within the framework of the Order within the meaning of the General Terms and Conditions (in the registration form or by another explicit and demonstrable expression of your will of the same content in the event that the Order is not carried out through the websitewww.amenity. cz), you grant this consent for business and marketing purposes – offers of trade, services and products and information about events and activities of both the Company and the companies listed in this point 3) sent by these companies electronically using your e-mail address and to process personal data for these purposes (including the transfer of data between these persons as processors or cooperating persons within the meaning of Section 14 of the Personal Data Protection Act to the extent necessary for the purpose);
- personal data may be processed for as long as necessary to achieve the stated purposes for which the personal data are processed, but no longer than for the duration of the relevant contract or until the rights and obligations under the contract have been fully settled (or for the period of time specified by the relevant legislation); in the case of data processing for commercial and marketing purposes, including the sending of commercial communications under the IS Services Act, for an indefinite period;
- The Company as a personal data controller is entitled, on the basis of a contract pursuant to Section 6 of the Personal Data Protection Act, to entrust another person with the processing of personal data as a processor, including the transfer of personal data for the defined purpose and scope of processing. In the case of personal data under point 2) letter b) processed for the purposes referred to in point 1) letter ii., this person is Česká podnikatelská pojišt’ovna a.s., Vienna Insurance Group, with registered office at Prague 8, Pobřežní 665/23, Postal Code 18600, ID No. 63998530; in the case of data under point 2) letter e) processed for the purposes referred to in point 1) letter v., these are companies forming a group within the meaning of the applicable legislation (in particular 3M Developer, a.s., ID 27196585, with registered office in Prague 4 -Kunratice, Postal Code 14800, Ratajova 1113/8), e-mail contact info@3mdeveloper.cz and GOLF EXPLOITATION s.r.o, IČ 25154010, with registered office in Prague 4 – Kunratice, Postal Code 14800, Ratajova 1113/8, e- mail contact info@golf-exploitation.cz The Company may also disclose and transfer the provided data to persons pursuant to § 14 of the Act cooperating with the Company as a controller on the basis of a contract, only to the extent and under the conditions set by the controller or processor; these persons have a legal or contractually assumed obligation of confidentiality;
- the personal data provided will be processed (manually or by means of computer technology) by persons specifically authorised to do so. The personal data will be stored securely in electronic or paper form with secure access;
- The Company shall (and on its instructions the processor shall) destroy the personal data once the purpose for which it was processed has ceased or upon your request pursuant to Section 21 of the Data Protection Act;
- you have rights under sections 11, 12 and 21 of the Data Protection Act, in particular the right to access your personal data and, upon your written request, the data controller will provide you with information about the personal data processed about you free of charge;
- you have the right if you believe that the data controller or processor is processing your personal data in violation of the protection of your private and personal life or in violation of the Data Protection Act:

- ask the data controller or processor for an explanation,
- request that the data controller or processor remedy the situation; the data controller or processor is obliged to remedy the situation without delay if your request is found to be justified;
- you have the right to contact the Data Protection Authority (www.uoou.cz) with a complaint or complaint; if the data controller or processor does not comply with your request under the previous paragraph, you may also contact the Authority directly,
- The Company declares that it will collect personal data to the extent necessary for the fulfilment of the stated purpose and will only process it in accordance with the purpose for which it was collected.
